What is a temporary layoff?

A temporary layoff refers to an employer’s unilateral decision to temporarily discontinue wages and work while the employment relationship continues. An employee can be temporarily laid off if temporary troubles hinder the company’s ability to operate or make payments. These are referred to as production-economic grounds for temporary layoffs.

The grounds for temporary layoffs should be reviewed in detail with the staff or shop steward in cooperation negotiations where other solutions are sought to avoid temporary layoffs. An employee may utilise temporary layoffs if other options discussed in the cooperation negotiations are not applicable to the company’s situation.

How can a temporary layoff be implemented?

By reducing the daily working hours.
● By reducing the weekly working hours.
● By temporarily laying off the person altogether.
● The temporary layoff can have a fixed duration or continue until further notice.
